What penalties am I facing?

Penalties for multiple DUI convictions get increasingly worse. You should be aware that Georgia has a 10 year “lookback” period, which means all convictions within this time will be counted as subsequent offenses.

Punishments for subsequent convictions include:

  • 2nd DUI —3 days to 1 year in jail, up to $1,000 in fines, 3 years’ license suspension
  • 3rd DUI —15 days to 1 year in jail, $1,000 to $5,000 in fines, 5 years’ license suspension
  • 4th (felony) DUI —1 to 5 years in jail, $1,000 to $5,000 in fines, indefinite suspension of your license

After your second conviction, you will also be required to pay for the installation and maintenance of an Ignition Interlock Device (IID) in your vehicle in order to prevent future drunk driving. You still have rights no matter how many DUIs you have been convicted of in the past. If police acted improperly in stopping you or arresting you, you could have your charges dismissed. Police must have probable cause in the first place to stop you and may not pull you over on a hunch or at random.
